While the specific terms of probation will vary depending on each individual, here are the general rules and regulations of A.R.D. supervision in a DUI case:
1. Report as directed by your Probation Officer.
2. Report any change of address, phone number, employment status, living conditions, etc., within 72 hours.
3. Do not leave the State of Pennsylvania without a travel permit from your probation officer.
4. Do not violate any laws -- municipal, state or federal.
5. Report any new arrest or citation to your Probation Officer within 72 hours.
6. Do not possess any firearms while under supervision unless granted written permission by your probation officer.
7. Do not possess, purchase, or drink alcoholic beverages, or frequent places that sell alcoholic beverages, according to instructions given by the Court or your Probation Officer.
8. Do not possess or use any controlled substances except as prescribed by a licensed physician for a legitimate medical need or as part of a licensed treatment program. You must provide the name and address of the physician or treatment program and sign a release form authorizing your Probation Officer to verify the information.
9. Do not display any assaultive, threatening, or harassing behavior.
10. Make payments as scheduled to the Clerk of Courts. You must request a payment extension if you cannot pay as scheduled. You will be charged with Contempt of Court if you do not fulfill your payment obligation.
11. Report to the C.A.R.E. Center (Stout School) at 351 West Beau Street, 200 Street Level, Suite 200, Washington, PA within 1 week and comply with all terms of the program including any recommendation for additional treatment. The phone number is (724) 229-5782. All Alcohol Highway Safety Program requirements are to be completed within the first 6 months of your ARD. Pay tuition directly to the C.A.R.E. Center. Notify your Probation Officer on your monthly report form of your completion of your DUI counseling/treatment. Submit your driver's license to the State as directed by PennDOT.
12. Upon failure to comply with the conditions of your ARD, the District Attorney may ask the Court to hold a hearing to determine if your ARD status should be revoked. Compliance with these conditions will result in your discharge from supervision when your ARD expires.
13. You or your attorney must file a petition to have your charges dismissed or expunged. ARD expungement packets are available through the Clerk of Courts' Office.
